Terms and Conditions

1. Acceptance of Terms

By creating an account, purchasing a plan, booking a class, or otherwise using BeTalkio, you agree to these Terms and Conditions. You must provide accurate account information and keep your login credentials secure.

2. Free Trial

Eligible users may receive a 7-day free trial. If the trial is connected to a recurring subscription, the subscription will begin and the applicable payment will be charged when the trial ends unless it is cancelled before the end of the trial. The applicable price and billing details will be shown before the trial is started.

3. Subscriptions and Plans

Recurring subscriptions operate in 28-day billing periods and renew automatically until cancelled. Cancelling a subscription prevents future renewals but does not normally refund payments already made or credits already issued. BeTalkio may also offer non-recurring plans and individual private-class credits.

4. Class Credits

Credits are used to book eligible classes and have a limited validity period:

• Unused subscription credits roll over to the next billing period and expire 56 days after they are issued.
• 12-week plan credits expire 120 days after they are issued.
• Single private class credits expire 180 days after they are issued.

Unused credits cannot be used after their expiration date. Except where required by applicable law or expressly stated in these Terms, credits and payments are non-refundable.

5. Booking and Cancelling Classes

Classes are subject to teacher and schedule availability. A student may cancel a booked class only when more than 72 hours remain before its scheduled start time. When an eligible cancellation is completed, the credit used for the booking will be returned to the student's account, subject to its original expiration date.

Once 72 hours or less remain before the scheduled class start time, the class can no longer be cancelled under the normal cancellation policy and the credit will not normally be refunded.

6. Missed Classes and Teacher No-Shows

If a student does not attend a scheduled class, the class will normally be considered used and the credit will not be refunded. BeTalkio may consider exceptional circumstances at its discretion.

If a teacher cancels a scheduled class or fails to attend, the student will not lose the credit used for that class. The credit may be returned to the student's account or an appropriate replacement class may be arranged.

7. Lesson Materials

Lesson materials are available only for lessons connected to a booked class. They become accessible when 72 hours or less remain before the scheduled class start time.

Course and lesson materials are provided for the student's personal educational use only. They may not be sold, redistributed, publicly uploaded, published, or shared with third parties without permission from BeTalkio.

8. Payments and Refunds

By purchasing a recurring subscription, you authorize BeTalkio and its payment provider to charge the applicable recurring amount until the subscription is cancelled. Except where required by applicable law or expressly provided in these Terms, completed payments and purchased credits are non-refundable.

9. Account Use and Conduct

Accounts are intended for the registered user and must not be shared. Users must not misuse the platform, attempt to circumvent payments or access restrictions, engage in fraudulent activity, or behave abusively or inappropriately toward teachers, staff, or other users. BeTalkio may suspend or terminate accounts for serious or repeated violations, fraudulent activity, abuse, or non-payment.

10. Account Deletion

To request deletion of a BeTalkio account, the user must contact BeTalkio support. Account deletion is separate from subscription cancellation. Users should cancel any active recurring subscription before requesting account deletion to prevent future renewals while the request is being processed.

11. Service Availability and Learning Outcomes

BeTalkio aims to provide reliable access to its platform, teachers, and learning services, but uninterrupted availability cannot be guaranteed. Students are responsible for having a suitable device, internet connection, and environment for online classes.

Learning progress depends on factors including participation, practice, attendance, and individual circumstances. BeTalkio does not guarantee a particular level of fluency, examination result, or learning outcome.

12. Intellectual Property

The BeTalkio platform, branding, course content, lesson materials, graphics, and other original materials are owned by BeTalkio or its licensors. Access to the service does not transfer ownership of this intellectual property to the user.

13. Changes to the Service and Terms

BeTalkio may reasonably update its services, features, plans, prices, policies, or these Terms from time to time. Where a change materially affects an existing subscription or the user's rights, reasonable notice will be provided where required.

14. Privacy

Personal information is handled in accordance with BeTalkio's Privacy Policy. By using the service, you acknowledge that personal information will be processed as described in that policy.

15. Limitation of Liability

To the maximum extent permitted by applicable law, BeTalkio will not be liable for indirect, incidental, or consequential losses arising from use of the service. Nothing in these Terms excludes or limits rights or liabilities that cannot legally be excluded or limited.

16. Governing Law

These Terms are governed by the laws applicable to the legal entity operating BeTalkio, subject to any mandatory consumer protection rights that apply to the user.
